Additional Definitions

As used herein, “Arrival” means the Guest’s arrival at the Airport where Villa Turrasann has arranged for transfer or arrival at the villa where the guest has arranged their own mode of transport for the start of their vacation. “Hotel” means the villa (Villa Turrasann) visited by Guest.

[/vc_column_text][/vc_column][/vc_row][vc_row css=”.vc_custom_1599836500763{padding-bottom: 20px !important;}”][vc_column][vc_column_text el_class=”frontheading” css=”.vc_custom_1600165876526{padding-bottom: 15px !important;}”]1. Travel Agents: Any travel agent used by Guest to make reservations is, for all purposes, Guest’s agent, and represents that the Travel Agent has the authority to receive notice of these Terms and Conditions on behalf of the Guest. Guest’s travel agent agrees also to promptly notify a Guest of these Terms and Conditions. Villa Turrasann shall not be liable for any representations made by Guest’s travel agent.

2. Rates:  All rates are subject to change at any time due to the imposition of taxes or other government charges or other events beyond Villa Turrasann’s control.

3a. Villa Turrasann endeavours to ensure that all the information and prices both on our website are accurate; however occasionally changes and errors occur and we reserve the right to correct prices and other details in such circumstances. You must check the current price and all other details relating to the arrangements that you wish to book before your booking is confirmed.

4. Payments required to secure reservation: At the time of booking, a 50% deposit of the total villa price must be paid. When the deposit has been paid, you the client/Guest agree to the terms of this booking policy.

4a. Payment: Villa Turrasann must receive full and final payment of the purchase price no later than 45 days prior to the date of Arrival. Bookings made 45 days or less prior to Arrival must be paid in full when booking. Villa Turrasann may cancel any booking at least 45 days prior to Arrival. The date for deposit, full and final payment may be subject to change during certain periods. Guest´s invoice and or email confirmation will provide notice of any such change. Payment and cancellation policy may vary during holiday periods.

5. Cancellation and amendments to reservation: If it becomes necessary to cancel all or any part of the booking, Villa Turrasann must be notified in writing (email acceptable). The cancellation will take effect from the day the written confirmation is received. The following cancellation charges will be payable depending on when the notification of the cancellation is received in writing. Should the renter have to cancel the reservation, the penalty will be calculated as a percentage of the total rate according to the date of cancellation.

–          Date of booking to 30 days after  – deposit returned **

–          30 days after booking – 90 days before arrival date – 40% 

–          89 days – 60 days before arrival – 50%

–          59 days – 31 days before arrival – 75%

–          30 days before arrival – 100%

If the cancellation is for a booking made in our Christmas and New Year Period, no refunds will be given on ANY payments made.

*Date of booking, is defined when confirmation of dates and billing information is given to Villa Turrasann and a confirmation email has been sent.

* In the case of a deposit returned, bank charges will not be included.

* Bookings made 45 days or less prior to arrival then full payment is expected, and no refunds will be given.

The closer your cancellation is to the departure date, the less likely we are to recover the costs by re-selling the dates. We advise you to get suitable holiday cancellation insurance.

If the dates of the booking require change or amendment, cancellation charges shall not apply. Any change to the original reservation is subject to the approval of Villa Turrasann.

6. Changes to Reservations: If Guest desire to change, but not cancel, a reservation, then they will be subject to the following. At any point prior to travel, guests making revisions to their bookings to upgrade (i.e. add nights, adding rooms, additional persons under the 6 person limit), there is no charge. Any other revisions to the booking (i.e. subtracting number of nights, subtracting rooms, or adding up to two more guests above the maximum of 6) received between 30 and 15 days of travel; a revision fee of 50% per person would apply. For other revisions received 14 days or less prior to travel; they will be subject to full penalty.

All requested changes to reservations are subject to Villa Turrasann sole discretion, and any changes must be approved in writing. Only one name change permitted. Changes are subject to all applicable government taxes and other charges and restrictions. If the revised reservation is subsequently cancelled, the cancellation penalties for the original dates of travel will apply.

7. Persons with Disabilities: Villa Turrasann is not disable accessible. Villa Turrasann cannot guarantee that destination airports, airport transfer vehicles are wheelchair accessible. Purchase price does not include any services that may be specially required as a result of disabilities.

8. Travel Documents: Guest are responsible for supplying proof of citizenship in the form of a valid passport, and any other documentation necessary for travel. Guest should consult with their travel agent or airline, or appropriate government authorities to ascertain what documentation is necessary. Guests may be refused passage/entry if they do not possess necessary travel documents. Villa Turrasann is not responsible for Guest’s failure to obtain and safeguard necessary travel documents.

9. Customs and Immigration: Customs and/or immigration officials may, at their own discretion, deny guest entry into their country, and/or seize, confiscate, or impound personal property. Villa Turrasann is not liable for any loss or injury arising from guest being denied entry into Jamaica or the seizure, confiscation, or impoundment of any personal property.

10. Compliance with Local Law: Guest are responsible for knowing, obeying and complying with the laws and regulations of their destination. Villa Turrasann has no duty to inform or warn Guest about the destination’s laws and/or regulations.           

11. FORUM SELECTION AND CHOICE OF LAW:

A. As against unique travel only:  All claims whatsoever against Villa Turrasann, its affiliates; subsidiaries, directors, officers, employees, agents or contractors, arising from, in connection with or incidental to the contract or guests visit to Villa Turrasann. Including, but not limited to, any claims relating to the formation, interpretation, construction, waiver, modification, performance, discharge, or breach of the contract, or the existence, extent, or breach of any fiduciary duty, or any duty in tort or pursuant to any statute, shall be litigated solely and exclusively in Jamaica, and shall be governed by the laws of government of Jamaica without regard to the choice of law principles thereof.

B. Claims which include Villa Turrasann. The foregoing in paragraph 11A notwithstanding any claims whatsoever arising from, in connection with, or incidental to any personal injury, illness or death, that include any claim whatsoever against Villa Turrasann, Villa management company, and/or their affiliates. Including subsidiaries directors, officers, or employees, and to which claim Villa Turrasann is also a party, shall be litigated solely and exclusively in the courts of the country in which the villa is physically located and governed exclusively by the laws of the country in which the villa is physically located, – Jamaica.

12. Limitation periods:  No suit shall be maintainable against Villa Turrasann of their affiliates, subsidiaries, directors, officers, employees, or agents relating to personal injury, illness or death or loss or damage to property, unless written notice of the claim, with particulars, is addressed to Villa Turrasann. ATTENTION: Claims to: Villa Turrasann, Runaway Bay, St Ann Jamaica, W.I, and are received within six months after the death or loss or damage to property, or the onset of the injury or illness. In NO event shall such suit be maintainable unless commenced within one year after death, loss or damage to property, or the onset of the injury or illness.

13. Limitation of damages: Villa Turrasann and its affiliates, subsidiaries, directors, officers and employees shall not be liable to guest in any circumstances, for; (a) Any personal injuries or property damage arising out of or caused by any act (b) emotional distress, mental suffering, or psychological injury of any kind; or (c) any consequential, incidental, punitive or exemplary damages.

14. All other defences preserved: Nothing in this contract shall exclude the application of any defence, including but not limited to any governing law limiting or excluding actions, claims, liability or damages.

15. Waiver of Liability: The guest will be required to follow signs provided for their safety when traveling around the property. Children less than 16 years of age must be accompanied by an adult at all times when using the swimming pool. Please familiarize yourself thoroughly with the depth of the pool and how to get out, and exercise safety and caution at all times, especially with children and non-swimmers. Children and non-swimmers are your responsibility at all times. No diving is permitted within the swimming pool, deep or shallow end.

Undersigned guest(s) acknowledges and agrees to follow all posted safety precautions related to the balconies and hand rails, including the strict prohibition against sitting or climbing on the wall(s) and/or edge(s) of the balconies. In doing so, undersigned guest(s) hereby discharges and holds harmless the release from all liabilities, claims, actions, damages, costs and/or expenses which may arise out of or in any way concern the undersigned guest’s ( or guests’) use of the balcony. Undersigned guest(s) understands and acknowledges that includes claims based on negligence and/or the action(s) or inaction(s) of the releases. As part of this agreement guests are required to take due care when residing at Villa Turrasann and especially children playing in the gardens, near the entrance from the main road; near or in the pool, on the beach, and including the sea. Furthermore guests are reminded not to enter the Villa wet, as the floors can be slippery. Injury, damage, death or injuring arising shall not be the responsibility of Villa Turrasann.

16. The person signing the contract is responsible for the correct and appropriate behaviour of the guests staying at the Villa. Villa Turrasann reserves the right, at its sole discretion, to release any reservation at any time without charge, penalty, loss or damage if it believes that the guests are unfit to stay in the villa. Unfit can mean being drunk, disorderly, abusive, aggressive or impolite or causing a danger to villa employees and contractors. Smoking is not permitted in any room of the Villa, however in the outside areas, such as the beach garden or poolside smoking is permitted.

16a. No pets are permitted into Villa Turrasann.

17. Valuables: Any valuables left at the property is left at ones risk. Neither Villa Turrasann nor the owners nor the staff are responsible for their loss or damage.

18. Bookings: Villa Turrasann will accept your inquiry for booking. Bookings are on a ‘first-come, first-served’ basis and are for a minimum of three (3) nights. Villa Turrasann reserves the right to decline a booking without giving any reason. A booking will be held confirmed once the initial deposit has been paid. An email confirmation will be sent to the client when the booking is confirmed. When the deposit has been paid, you the client/Guest have agreed to the terms of this booking policy

19. Insurance: Villa Turrasann shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside Villa Turrasann’s control, such as civil disturbances, fires, floods, sever weather, Acts of God, and acts of Government etc. Villa Turrasann is held harmless by you and your party against all claims including accidents related to the use of the Villa facilities or locally procured third party services such as, but not limited to, watercraft, water sports, and jeep or motorbike rental.

AGREEMENT: I/We agree to the above terms and conditions and do hereby agree to the above.
